Combined Life Insurance Company of New York Protections for Domestic Violence Victims under § 2612 of the New York Insurance Laws

New York Insurance Law §2612 provides Victims of Domestic Violence specific protections by prohibiting insurers from taking certain actions solely because the person is or has been a victim of domestic violence, including:

  • refusing to issue or renew an insurance policy, or denying / cancelling any insurance policy or contract;
  • demanding or requiring that a victim of domestic violence pay greater premium;
  • designating domestic violence as a preexisting condition, for which coverage will be denied or reduced;
  • fixing any lower rate or discriminating in the fees or commissions of agents or brokers for writing or renewing a policy for a victim of domestic violence; or
  • using the fact that a person is or has been a victim of domestic violence as an underwriting criterion.

In addition to the protections noted above, effective January 1, 2013, health insurers are required to accommodate a reasonable request made by a person covered under its insurance policy to receive communications of claims-related information by alternative means or at an alternative location if the person clearly states that disclosure of the information could endanger the person. If a child is the covered person, then this right may be asserted by the child’s parent or guardian.

Within three business days of receiving a confidential communication request form, except with the express consent of the person making the request, Combined Insurance will not disclose to the policyholder or other insured under the policy: (1) the address, telephone number, or any other personally identifying information of the person who made the request, or of any child residing with the person who made the request, or of any child for whose benefit a request was made; (2) the nature of the health care services provided; or (3) the name, address or telephone number of the provider of the services; or (4) any other information from which there is a reasonable basis to believe the foregoing information could be obtained.

Once a confidential communication request has been honored, the request will remain in effect until the requestor submits a sworn and notarized statement revoking the previous request and faxing or mailing the revocation to the facsimile or address noted above.

How We Collect Personal and Non-Personal Information through the Online Services

We collect two kinds of information through the Online Services: non-personal information and personal information.

The non-personal information we collect includes: the visitor’s browser type, device type, and operating system; area(s) of the Online Services visited; date and time of access; host or Internet service provider (ISP) information; and identity of the referring site (any site from which the visitor accessed the Online Services).

Children’s Privacy

The privacy of children online is an important issue to Combined, and Combined encourages parents to supervise their children’s activities online.  Combined does not seek or knowingly collect personal information from children under the age of 13. Combined requests that children under the age of 13 not disclose or provide any personal information through the Online Services. If we learn that we have received information directly from a child who is under the age of 13, we will take appropriate action in accordance with applicable law. How We Use Your Information

We may use the information we collect through the Online Services for a number of purposes including:

  • to provide you with, renew or modify products and services;

How We Collect, Use and Protect Social Security Numbers

Combined may collect Social Security numbers (“SSNs”) in the course of our business.  We strive to protect the confidentiality and security of SSNs in our possession, custody or control by: (i) limiting access to SSNs and (ii) maintaining reasonable administrative, technical and physical safeguards to protect against the loss, misuse or unlawful disclosure of SSNs.  We do not share SSNs for marketing purposes.

How We Use “Cookies” and Other Data Collection Tools

Cookies. Combined may place electronic “cookies” in the browser files of your computer or mobile device when you access a Combined website.  Cookies are pieces of information that a Combined website transfers to your computer or mobile device to enable our systems to recognize your browser and to tailor the information on our websites to your interests.  For example, if you previously visited a Combined website and accessed your account information or inquired about particular services over the website, cookies enable us to present information tailored to your account and/or those particular interests the next time you visit the website.  Moreover, Combined or our third party service providers or business partners may place cookies on your computer or mobile device that can be matched to other personal information we maintain about you to pre-populate certain online forms for your convenience.  We also use cookies to analyze visitors’ use of our websites.  This analysis helps us better understand which areas of our sites are most useful and popular so we can plan improvements and updates accordingly. Why are cookies important for the use of Combined websites?

Types of Cookies

Combined provides a separate HIPAA privacy notice to certain individual consumers as required under applicable laws and regulations.

Personal information we collect in connection with the issuance of financial products or services to you that are to be used primarily for your personal, family, or household purposes and that is subject to the Gramm-Leach-Bliley Act (“GLBA”) or the California Financial Information Privacy Act. For example, where we provide you with a personal insurance policy, or where we handle a claim from you as an individual. Note that this exclusion may not apply to all of your personal information, including to personal information collected before you become a customer.

Combined provides a separate GLBA privacy notice to certain individual consumers as required under applicable laws and regulations.

Personal information we collect about job applicants, independent contractors, or current or former full-time, part-time and temporary employees and staff, officers, directors or owners of Combined, and that is used solely in that context.

How Do We Collect Personal Information Subject to this California Section of the Internet Privacy Policy? 

Combined collects personal information about you, your household and the members of your household to conduct business operations, provide customer service, offer new products and satisfy legal and regulatory requirements.  The type of personal information we collect depends on the financial product or service (if any) that you have with us.  We may collect the categories of personal information listed above from the following categories of sources:

  • information from you directly or from our agent, broker or other representative, including information from applications, worksheets, questionnaires, claim forms or other documents (such as name, address, driver’s license number, Social Security number and amount of coverage requested);
